Welcome to KMC Merch. These Terms & Conditions govern your use of our website and the purchase of our products. By accessing our website or placing an order, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please refrain from using our website or services.

1. About KMC Merch

KMC Merch is a Philippine-based business specializing in high-quality made-to-order, personalized, and 3D-printed products. Our goal is to provide products that combine functionality, craftsmanship, and modern design while delivering excellent customer service.

2. Acceptance of Orders

All orders are subject to review and acceptance by KMC Merch.

We reserve the right to refuse, limit, or cancel any order for reasons including, but not limited to:

  • Product availability
  • Pricing or listing errors
  • Incomplete or inaccurate order information
  • Suspected fraudulent transactions
  • Violation of these Terms & Conditions

If we are unable to fulfill your order after payment has been received, we will notify you and provide an appropriate refund when applicable.

3. Product Information

We strive to ensure that all product descriptions, specifications, dimensions, and photographs accurately represent our products.

However, customers acknowledge that:

  • Actual product colors may vary slightly due to differences in monitor or mobile display settings.
  • Product dimensions may have minor manufacturing tolerances.
  • 3D-printed products naturally exhibit layer lines and slight surface variations that are characteristic of the manufacturing process and are not considered defects.
  • Minor improvements or design refinements may be made to our products without prior notice, provided they do not materially affect the product's intended function.

4. Made-to-Order & Personalized Products

Most KMC Merch products are manufactured only after an order has been confirmed.

Customers are responsible for carefully reviewing all submitted information before completing their purchase, including but not limited to:

  • Names
  • Initials
  • Personalized text
  • QR code information
  • Uploaded images or logos
  • Colors
  • Sizes
  • Design selections

Orders for personalized or custom-made products may only be modified or cancelled before production begins.

Once production has started, changes or cancellations can no longer be accommodated.

5. Pricing

All prices displayed on our website are in Philippine Pesos (PHP) unless otherwise stated.

Prices are subject to change without prior notice. However, confirmed and paid orders will not be affected by future price adjustments.

6. Payment

Production begins only after payment has been successfully confirmed unless an alternative arrangement has been agreed upon.

KMC Merch reserves the right to cancel unpaid orders after a reasonable period.

7. Digital Previews & Mockups

When applicable, KMC Merch may provide digital previews, mockups, renders, or AI-generated visualizations to help customers visualize the final product before production.

These previews are intended as a representation only.

Because our products are physically manufactured using 3D printing and other production methods, slight differences in color, texture, finish, proportions, or overall appearance may occur between the preview and the finished product.

Such differences are considered normal and do not constitute manufacturing defects.

8. Product Photography

We make every effort to ensure that product photographs accurately represent the items we sell.

However:

  • Product images may include decorative props, accessories, or display items for presentation purposes.
  • Unless specifically stated in the product description, only the product described in the listing is included with your purchase.
  • Colors may appear differently depending on your device's display settings.

9. Intellectual Property

All original designs, product concepts, photographs, graphics, logos, website content, marketing materials, and other creative works produced by KMC Merch remain the exclusive intellectual property of KMC Merch unless otherwise stated.

No content may be copied, reproduced, modified, distributed, or used for commercial purposes without prior written permission.

10. Customer-Provided Content

Customers retain ownership of any artwork, logos, images, names, trademarks, or other materials submitted for personalization.

By submitting such content, you confirm that:

  • You own the rights to use it; or
  • You have obtained permission from the rightful owner.

KMC Merch is not responsible for copyright, trademark, or other intellectual property disputes arising from customer-submitted content.

11. Product Usage

Customers are responsible for using our products safely and only for their intended purpose.

KMC Merch shall not be responsible for damage resulting from:

  • Improper use
  • Unauthorized modifications
  • Accidental damage
  • Negligence
  • Normal wear and tear
  • Exposure to excessive heat, direct flames, harsh chemicals, prolonged sunlight, or other environmental conditions beyond the intended use of the product

12. Limitation of Liability

To the fullest extent permitted by applicable law, KMC Merch shall not be liable for any indirect, incidental, consequential, or special damages arising from the purchase or use of our products.

Our maximum liability shall not exceed the purchase price of the affected product.

Nothing in these Terms & Conditions limits any rights that consumers may have under applicable Philippine law.

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines.

Any disputes arising from these Terms & Conditions or from the purchase of our products shall be subject to the jurisdiction of the appropriate courts of the Philippines.

KMC Merch reserves the right to update or modify these Terms & Conditions at any time.

Any revisions will become effective immediately upon publication on this website unless otherwise specified.

Customers are encouraged to review this page periodically for updates.

17. Product Design & Customization

Many KMC Merch products are original designs developed in-house or customized specifically for each customer.

Unless otherwise agreed in writing:

  • Purchasing a product does not transfer ownership of its design or intellectual property.
  • Customers may use purchased products for personal or business purposes as intended, but may not reproduce, copy, scan, reverse engineer for commercial reproduction, or sell copies of KMC Merch's original designs without prior written permission.
  • Custom designs created exclusively for a customer remain subject to any separate agreement regarding ownership and usage rights.
